What federal law says
There is no single line in federal law that says 'mental health,' which confuses people. Therapy is paid for through mandatory physician, outpatient hospital and health center services, and through optional categories that nearly every state has adopted: clinic services, other licensed practitioners (which is where counselors and social workers bill), rehabilitative services, and Certified Community Behavioral Health Clinics. Medicaid.gov describes the program as the single largest payer for mental health services in the United States.
For expansion adults the coverage is mandatory rather than pieced together: the alternative benefit plan must include mental health and substance use disorder services, including behavioral health treatment, as one of the ten essential health benefits, and federal parity rules apply to managed care plans, alternative benefit plans and CHIP.
Medication-assisted treatment for opioid use disorder, including buprenorphine and methadone, is a mandatory benefit in every state under section 1905(a)(29).
Children under 21
EPSDT covers all medically necessary mental health services for anyone under 21, including therapy, in-home services and residential treatment.
What to ask your state plan
- If you cannot find a therapist who takes Medicaid, ask the plan for its network adequacy contact; managed care plans are required to have one.
- Community mental health centers and CCBHCs take Medicaid and usually have shorter waits than private practices.
